When a passenger or booking party provides a mobile telephone number in connection with a chauffeur-service booking, DriverNow GmbH may use that number to send transactional SMS messages concerning the relevant booking or service.

• driver arrival notifications;

• pickup-time or pickup-location updates;

• journey or service changes;

12. Bookings Made by Another Person or Organisation

A booking may be arranged by a corporate customer, travel arranger, hotel, agency, booking platform or another authorised party. The party providing the passenger’s mobile number is responsible for ensuring that it is authorised to provide the number for communications necessary to administer that booking. Where separate SMS consent is legally or contractually required, the booking party must ensure that valid consent has been obtained before the number is enrolled in recurring messaging.

Consent is specific to DriverNow GmbH and the stated messaging purpose. SMS consent cannot be sold, transferred or treated as consent to unrelated marketing communications.

13. Message Frequency and Charges

​

Message frequency varies according to the number, timing and status of the recipient’s bookings.

Recipients may receive multiple messages during a journey, including messages concerning booking confirmation, driver assignment, driver arrival, changes or customer assistance.

Message and data rates may apply according to the recipient’s mobile telephone plan and carrier.

DriverNow GmbH does not charge a separate fee merely for receiving an SMS, although the recipient’s mobile carrier may apply charges.

14. Opting Out

Recipients may opt out of SMS messages at any time by replying: STOP

After receiving a valid opt-out request, DriverNow GmbH or its messaging provider may send one final confirmation message stating that the recipient has been unsubscribed.

No further recurring SMS messages will be sent under the campaign unless the recipient later provides valid consent again.

Other commonly supported opt-out keywords may include:

• STOP;

• END;

• CANCEL;

• UNSUBSCRIBE;

• QUIT.

 

Opting out of SMS does not cancel an existing chauffeur booking. Important service information may still be communicated through another appropriate channel, such as telephone or email.

16. Mobile Information and Non-sharing

Mobile information may be disclosed to service providers, telecommunications providers, booking-system providers, dispatch providers and messaging platforms only where reasonably necessary to operate the requested service, transmit transactional messages, maintain systems, provide customer support or comply with legal obligations. Such service providers may not use the mobile information for their own unrelated marketing or promotional purposes.

20. Consent is not required for purchase

Consent to receive recurring SMS messages is not a condition of purchasing, booking or receiving chauffeur services from DriverNow GmbH. A person may decline SMS consent and, where operationally possible, request communications through another available channel.

21. Recipient responsibilities

The recipient is responsible for:

• providing a valid and current mobile telephone number;

• ensuring that they are authorised to use the number provided;

• informing DriverNow GmbH if the number changes or is no longer under their control;

22. Delivery and Availability

​

SMS delivery depends on mobile-network availability, carrier routing, the recipient’s device, coverage, account status and other factors outside the direct control of DriverNow GmbH.

DriverNow GmbH does not guarantee that every SMS will be delivered immediately, without interruption or at all. Mobile carriers are not liable for delayed or undelivered messages.

Recipients should not rely exclusively on SMS where urgent assistance is required and should contact DriverNow GmbH directly when necessary.

23. Supported carriers and international delivery

​

The availability and appearance of SMS messages may vary according to the recipient’s country, carrier and device.

In some countries:

• the sender may appear as a telephone number;

• the sender may appear as an alphanumeric name;

• replies may not be supported;

• local carrier restrictions may apply;

• delivery may require a registered sender.

 

24. Opt-out effect

 

Replying STOP withdraws consent for recurring messages under the relevant SMS campaign.

An opt-out does not:

• cancel a booking;

• terminate a contract;

• waive amounts due;

• prevent DriverNow GmbH from responding to a direct customer enquiry;

• prevent legally required communications;

• prevent urgent one-to-one contact through another appropriate channel.

 

25. Changes tot he SMS Service

DriverNow GmbH may modify, suspend or discontinue its SMS service where reasonably necessary for technical, operational, legal or compliance reasons. We may update these terms from time to time. The current version will be published on this webpage.

26. Privacy

​

Personal data processed in connection with SMS messages is handled in accordance with this Privacy Policy.

In particular, mobile telephone numbers and SMS opt-in data will not be shared with third parties or affiliates for their own marketing or promotional purposes.

27. Limitation of liability

To the extent permitted by applicable law, DriverNow GmbH is not liable for losses arising solely from:

• delayed or failed mobile-network delivery;

• an incorrect telephone number supplied by the recipient or booking party;

• a recipient’s device being switched off, unavailable or unable to receive SMS;

• actions or failures of telecommunications carriers or external messaging providers;

• unauthorised access caused by a recipient failing to secure their device.

 

Nothing in these terms excludes liability that cannot lawfully be excluded.
